ParticipantFollowing up on this – I am, in Utah, required to register as a post-secondary school. It has been quite the application process with my atttorney helping.
Also, in the USA, Utah is the only state that takes issue with the word “Institute” in a business name. So, heads up to our Utah trainers. I was a fish that got caught in the net. If you stay quiet, you won’t go through what I wnent through, but technically, you should be registered as a post-secondary school if you have students in Utah or are teaching in Utah and issuing certifications.

ParticipantUpdate. Yes, I am required by the State of Utah to register as a post-secondary school.
Apparently anyone else doing the same thing I’m doing should be registered as well.
I’ve had my attorney on it, three different conversations with the board, and I am not exempt. If I am offering a skill that gives people a pathway to a new career, in the State of Utah you are required to go through the registration process with the Utah Board of Consumer Protection.Utah trainers take note.
It doesn’t matter if you are a virtual school, if you operate out of Utah you must register. 🙁 Extra hoops to jump through.

ParticipantIt isn’t new regulations. What happened was – I named my biz “iHeal Institute”. I was offering programs thorugh my existing LLC, Rebecca Overson Holdings, as I already have an existing coaching business.
My attorney went to register iHeal Institute LLC, and was notified that because of the word “institute”, it has to go through the Utah Division of Consumer Protection, to either apply or see if I am exempt.
After speaking with the person in charge of the DCC, he asked me many questions about what I teach and how I deliver education, certifications, what I charge, etc. And he said I am NOT exempt, and that I need to register as a post-secondary institution.
I have had another call with my attorney about it because I am just baffled – I’m not offering “academic credits” or “continuing education” or professional certificates – just certificates of completion etc…
There seems to be a disconnect somewhere and I’m still getting to the bottom of it as I have never heard another NLP training program having to be registered legally as a “school” or institute of higher learning.
I’ll keep you guys posted.

ParticipantThanks for your replies. And where can I find how many hours are required in a prac, for certification, specifically, the breakdown of it? I see 120 hours of NLP training with a trainer is required, but I only add up 64 hours in an 8 day training, 8 hours a day… plus not even all of that is NLP because we are covering TLT and Hypno. Help 🙂
